Busan Metropolitan City Ordinance on Health Promotion and Chronic Disease Prevention Management

Busan Metropolitan City Ordinance No. 7295, 22. May, 2024., Enactment
- Article 1 (Purpose)
- The purpose of this Ordinance is to extend citizens’ healthy lifespan by stipulating matters necessary for health promotion and the prevention and management of chronic diseases, in accordance with Article 3 of the National Health Promotion Act and Article 41 of the Framework Act on Health and Medical Services.
- Article 2 (Definitions)
- The terms used in this Ordinance are defined as follows:
- 1. The term “Chronic disease” means diseases that have high prevalence or mortality rates and impose significant disease burdens, necessitating management. These include:
- a. Diseases as defined in Article 2 (1) of the Prevention and Management of Cardio-Cerebrovascular Diseases.
- b. Allergic diseases (asthma, atopic dermatitis, allergic rhinitis) and cancer.
- 2. The term “Prevention Management” means discovering diseases early and providing healthcare management services through health education.
- 1. The term “Chronic disease” means diseases that have high prevalence or mortality rates and impose significant disease burdens, necessitating management. These include:
- Article 3 (Responsibilities of the Mayor)
- The Mayor of Busan Metropolitan City (hereinafter referred to as “Mayor”) shall endeavor to promote health and prevent chronic diseases for the citizens of Busan Metropolitan City (hereinafter referred to as “Citizens”).
- Article 4 (Establishment of Prevention Management Plans)
- (1) The Mayor shall establish and implement a prevention management plan every four years to promote health and prevent chronic diseases.
- (2) The prevention management plan shall include the following:
- 1. Goals and direction of prevention management projects.
- 2. Plans and implementation methods for prevention management projects.
- 3. Management of healthcare resources within the region and financial support measures for prevention.
- 4. Other matters deemed necessary by the Mayor for health promotion and chronic disease prevention.
- (3) If the regional health and medical plan under Article 7 (1) of the Regional Public Health Act includes the matters outlined in paragraph (2), the prevention management plan shall be deemed established.
- Article 5 (Establishment of Implementation Plans)
- (1) Based on the prevention management plan, the Mayor shall annually establish and implement an implementation plan.
- (2) The Mayor may request cooperation from relevant institutions or organizations for data provision and other assistance to establish and implement the implementation plan.
- (3) If the annual implementation plan under Article 7 (2) of the Regional Public Health Act includes the matters outlined in paragraph (1), the implementation plan shall be deemed established.
- Article 6 (Evaluation of Implementation Plans)
- (1) The Mayor shall evaluate the results of the implementation plan.
- (2) The Mayor shall reflect the evaluation results in the next year’s implementation plan and take them into account when providing financial support.
- Article 7 (Promotion of Projects)
- The Mayor shall promote the following projects for the prevention and early detection of chronic diseases:
- 1. Health promotion projects, including smoking cessation, alcohol control, exercise, nutrition, obesity prevention, atopy/asthma prevention, and oral health management.
- 2. Health screening projects for the early detection of chronic diseases.
- 3. Healthcare services, including home visits, education, and counseling, for medically vulnerable groups.
- 4. Other projects deemed necessary by the Mayor for health promotion and chronic disease prevention.
- Article 8 (Establishment of Project Support Team)
- (1) The Mayor may establish a project support team to provide technical support, education, publicity, and evaluation for health promotion projects.
- (2) The project support team shall perform the following tasks:
- 1. Support the establishment and implementation of prevention and implementation plans.
- 2. Educate staff responsible for projects in districts and counties.
- 3. Provide education and promotional support for district and county projects.
- 4. Provide technical and evaluation support to districts and counties.
- 5. Conduct research and surveillance related to health promotion and chronic disease.
- 6. Other tasks deemed necessary by the Mayor for health promotion and chronic disease prevention.
- (3) The Mayor may delegate the operation of the project support team to corporations or organizations under Article 19-2 (2) of the Enforcement Rules of the National Health Promotion Act.
- (4) Matters not specified in this Ordinance regarding the delegation of services under paragraph (3) shall be governed by the Busan Metropolitan City Basic Ordinance on the Entrustment and the Busan Metropolitan City Ordinance on the Entrustment and Agency of Affairs to Public Institutions.
- Article 9 (Statistics Management)
- (1) The Mayor may conduct a fact-finding survey and collect and manage statistics and information necessary for chronic disease prevention and management, such as the prevalence and management status of chronic diseases, to promote citizens' health.
- (2) The Mayor may provide necessary information related to citizens’ health to relevant institutions, facilities, organizations, and citizens based on the data collected under paragraph (1).
- (3) The Mayor may conduct epidemiological investigations as necessary to identify the causes of chronic disease occurrences and other related matters based on the results of the fact-finding survey under paragraph (1).
- Article 10 (Financial Support)
- The Mayor may provide subsidies within the budget to districts, counties, institutions, or organizations implementing the projects outlined in Article 7 to promote citizens' health and prevent chronic diseases.

- This ordinance shall enter into force on the date of its promulgation.
