BUSAN METROPOLITAN CITY ORDINANCE ON SUPPORT FOR BUSAN INTERNATIONAL FILM FESTIVAL

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe matters necessary for supporting an international film festival held in Busan Metropolitan City in accordance with Article 28-5 (3) of the Promotion of the Motion Pictures and Video Products Act.
  • Article 2 (Responsibilities)
  • The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall endeavor to prepare policy measures necessary for enhancing the prestige of the international film festival and promoting its development, as well as measures for providing support required therefor.
  • Article 3 (Guarantee of Autonomous Operation)
  • The international film festival shall be guaranteed independence and autonomy in its operation.
  • Article 4 (Eligibility for Support)
  • (1) The Mayor may provide support to an international film festival that satisfies all of the following requirements:
    • 1. It shall be hosted and organized by a corporation or organization with its registered address in Busan Metropolitan City;
    • 2. It shall be held for at least five days, including opening and closing days, over at least three consecutive years immediately preceding the year in which support is provided;
    • 3. It shall have a history of featuring at least 50 films from 10 countries or more, at least 50 percent of which are from foreign countries, on a three-year average basis, immediately preceding the year in which support is provided.
  • (2) Corporations or organizations eligible for support under the criteria provided in paragraph (1) (hereinafter referred to as "international film festival organizer”) shall be as listed in the Appendix: Provided, That any international film festival organizer that satisfies the criteria specified in paragraph (1) may be eligible for support even before the amendment of the Ordinance.
  • Article 5 (Details of Support)
  • (1) For the development of the video culture and the video industry, the Mayor may provide an international film festival organizer with support necessary for the following projects:
    • 1. Inviting and screening domestic and foreign films at the international film festival;
    • 2. Holding supplementary events related to the international film festival;
    • 3. Producing and distributing domestic and foreign films;
    • 4. Awarding domestic and foreign films at the international film festival;
    • 5. Utilizing local film shooting-related facilities and locations;
    • 6. Other projects deemed by the Mayor to be necessary for the development of the video culture and the video industry.
  • (2) The Mayor may provide financial support for the expenses required for the hosting and operation of the international film festival, within the budget.
  • Article 6 (Submission of Business Plan)
  • Article 7 (Guidance and Supervision)
  • (1) The Mayor may require the submission of data on the business affairs, accounting, property, etc. of an international film festival under the relevant statutes or regulations, such as the Act on Management of Local Government Subsidies, or may provide guidance and supervision as necessary.
  • (2) If any illegality or wrongdoing is identified as a result of the guidance and supervision under paragraph (1), the Mayor may request the rectification thereof.
  • Article 8 (Establishment of Collaborative Network)
  • The Mayor may establish a collaborative network with the relevant committees, institutions, corporations, organizations, etc. to support the development and efficient operation of the international film festival.
  • Article 9 (Application Mutatis Mutandis)
  • Except as provided in this Ordinance, necessary matters shall be governed by relevant statutes or regulations, such as the Promotion of the Motion Pictures and Video Products Act, the Local Finance Act, and the Act on Management of Local Government Subsidies, and by relevant ordinances such as Busan Metropolitan City Ordinance on the Management of Local Subsidies.

ADDENDUM

  • This Ordinance shall enter into force on the date of its promulgation.
