BUSAN METROPOLITAN GOVERNMENT FRAMEWORK ORDINANCE ON LOW CARBON, GREEN GROWTH

CHAPTER Ⅰ GENERAL PROVISIONS

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to comprehensively implement Busan Metropolitan Government's policies on low carbon, green growth and, thus, contribute to the sustainable development and the improvement of the quality of life of residents by providing for matters delegated by the Framework Act on Low Carbon, Green Growth and the Enforcement Decree of said Act and matters necessary for the enforcement thereof.
  • Article 2 (Basic Principles for Promotion of Low Carbon, Green Growth)
  • The Busan Metropolitan Government (hereinafter referred to as the "Metropolitan Government") shall promote low carbon, green growth in accordance with the following basic principles:
    • 1. The Metropolitan Government shall realize low carbon, green growth by encouraging all citizens to participate in related activities and cooperating with enterprises, economic organizations and non-governmental organizations so that green life can be implemented in a daily life of residents and business activities;
    • 2. The Metropolitan Government shall implement comprehensive development strategies, including the resolution of problems in climate change, energy, and resources, the extension of growth engines, the enhancement of competitiveness of enterprises, the efficient utilization of national land, and the development of a comfortable environment;
    • 3. The Metropolitan Government shall invigorate market functions to the maximum to promote low carbon, green growth under the initiative of the private sector;
    • 4. The Metropolitan Government shall establish a new economic system that can generate and increase new jobs by utilizing green technology and green industries as core engines for economic growth;
    • 5. The Metropolitan Government shall increase investment and assistance in the areas of green technology and green industries highly capable of growth and highly competitive in order to use resources in the region efficiently;
    • 6. The Metropolitan Government shall raise the efficiency in the use of energy and resources for social and economic activities and facilitate the cycling of resources;
    • 7. The Metropolitan Government shall rearrange infrastructure, such as national land, urban area, buildings, transportation means, roads, ports and harbors, waterworks, and sewerage systems for low carbon, green growth, while preserving the value of natural resources and the environment.
  • Article 3 (Metropolitan Government's Responsibilities)
  • (1) The Metropolitan Government shall take into consideration local characteristics and conditions when it establishes and enforces measures for low carbon, green growth.
  • (2) The Metropolitan Government shall take into comprehensive consideration the impact that various plans and projects have on low carbon, green growth in the course of the establishment of such plans and the execution of such projects and shall intensify education and promotion of low carbon, green growth to local residents.
  • (3) The Metropolitan Government shall take measures necessary for providing information and financial support in order to encourage business entities, residents, and non-governmental organizations to conduct activities for low carbon, green growth, such as the reduction of greenhouse gases and the conservation of energy.
  • Article 4 (Relationships with Other Ordinances)
  • (1) This Ordinance shall take precedence over other Ordinances in relation to low carbon, green growth.
  • (2) When it is intended to enact or amend any other Ordinance in relation to low carbon, green growth, such enactment or amendment shall be made in conformity with the purpose and basic principles of this Ordinance.
  • (3) Plans and policies established by the Metropolitan Government pursuant to any other Act or subordinate statute with regard to low carbon, green growth shall be harmonized with the basic principles of this Ordinance and the Busan Metropolitan Government's plan for low carbon, green growth under Article 5.

CHAPTER Ⅱ PLAN FOR PROMOTION OF GREEN GROWTH AND GREEN GROWTH COMMITTEE

  • Article 5 (Establishment of Plan for Promotion of Green Growth)
  • The Mayor of the Busan Metropolitan Government (hereinafter referred to as the "Mayor") shall establish and implement a plan for the promotion of green growth of Busan Metropolitan City (hereinafter referred to as the "plan for the promotion of green growth") pursuant to Article 11 (1) of the Framework Act on Low Carbon, Green Growth (hereinafter referred to as the "Act") in order to promote low carbon, green growth.
  • Article 6 (Inspection and Evaluation of Current Status of Promotion)
  • (1) When the Mayor inspects and evaluates the current status of the performance of the plan for the promotion of green growth pursuant to Article 9 (1) of the Enforcement Decree of the Framework Act on Low Carbon, Green Growth, he/she shall ensure reliability and impartiality in the results of such inspection and evaluation in an objective and expert manner.
  • (2) Institutions subject to the inspection and evaluation under paragraph (1) shall be the main office of the Metropolitan Government, affiliated agencies, subsidiary offices, Gus, and Guns under its direct control.
  • (3) If the Mayor considers it necessary for objective, expert inspection and evaluation, he/she may have outside experts participate in the inspection and evaluation.
  • (4) No outside expert who participates in inspection and evaluation shall divulge any confidential information which becomes known to him/her in the course of the performance of his/her duties.
  • (5) Outside experts who participate in inspection and evaluation may be reimbursed for allowances, travel expense, and other necessary expenses within budgetary limits.
  • 1.1. Article 7 (Formation and Operation of Green Growth Committee)
  • (1) The Mayor shall establish the Green Growth Committee of the Busan Metropolitan Government (hereinafter referred to as the "Committee") pursuant to Article 20 (1) of the Act to have the Committee deliberate on major policies and plans regarding low carbon, green growth and the implementation of such policies and plans.
  • (2) The Committee shall be comprised of not more than 50 members, including two chairpersons.
  • (3) The Economy Deputy Mayor and the Mayor’s appointee out of the appointed members, pursuant to Paragraph 4 Subparagraph 2, shall act as the chairperson of the Committee.
  • (4) Members of the Committee shall be either appointed or commissioned by the Mayor from among the following persons:
    • 1. Class-Ⅲ or higher-ranking public officials from the Metropolitan Government;
    • 2. Persons who have good knowledge and experience in low carbon, green growth, such as climate change, energy, resources, green technology, green industries, and sustainable development.
  • (5) The Committee shall constitute upon the incidence of an agenda and dissolve automatically after deliberation and decision.
  • (6) Each chairperson shall represent the Committee and shall have overall control over affairs of the Committee.
  • (7) The chairperson of the Economy Deputy Mayor shall designate a member, who shall act on behalf of the chairperson in the event that the chairperson is unable to carry out his/her duties due to an unavoidable reason.
  • (8) The Committee shall have one secretary to have the secretary perform administrative affairs of the Committee, and the Director of the Division in charge of low carbon, green growth shall serve as the secretary.
  • Article 8 (Meetings)
  • (1) The chairpersons shall convene meetings of the Committee and shall preside over such meetings.
  • (2) Deleted
  • (3) When the chairpersons intend to convene a meeting, they shall notify each committee member of the time and items on the agenda by not later than seven days before the opening date of the meeting: Provided, That the foregoing shall not apply to an emergency case or where there exists any other exceptional circumstance.
  • (4) A meeting of the Committee shall be duly formed with the attendance of the majority of incumbent committee members and shall adopt a resolution by a concurrent vote of a majority of committee members present at the meeting.
  • Article 9 (Subcommittees)
  • (1) The Committee may have a subcommittee for each area to have the subcommittee carry out affairs of the Committee, assist the Committee efficiently, and review, settle, or handle affairs delegated by the Committee.
  • (2) The subcommittee shall consist of up to fifteen members appointed by the chairperson of the Economy Deputy Mayor out of the members of the Committee, and the chairperson of the subcommittee shall be elected out of the members of the subcommittee.
  • (3) Except as provided for in this Ordinance, matters necessary for the formation and operation of subcommittees shall be determined by the chairpersons of the Committee, subject to prior resolution of the Committee.
  • Article 10 (Allowances, etc.)
  • Commissioned members may be reimbursed for allowances and travel expense within budgetary limits.

CHAPTER Ⅲ REALIZATION OF LOW CARBON, GREEN GROWTH SOCIETY

  • Article 11 (Fostering and Support of Green Technology, Green Industries, etc.)
  • (1) The Mayor shall realize economies pursuing sustainable development (hereinafter referred to as "green economies") by reducing the consumption of fossil fuel and fostering green technology and green industries.
  • (2) The Mayor shall endeavor to foster and support green technology and green industries by raising the robustness and competitiveness of local economies through realization of green economies and searching for and fostering new green industries with high potential for growth.
  • (3) If the Mayor considers it necessary for supporting enterprises related to green technology and green industries or implementing green life, including the proliferation of energy-efficient vehicles and environment-friendly buildings, he/she may implement tax cuts for city taxes of the Busan Metropolitan Government in accordance with the Restriction of Special Local Taxation Act.
  • (4) The Mayor shall endeavor to encourage and support local small and medium enterprises to save energy, develop and disseminate green technology, and train professional human resources for green technology and green industries.
  • Article 12 (Promotion of Efficient Use of Energy in Public Sector)
  • (1) The Mayor shall establish policies under which public buildings can take the lead in proliferating green buildings pursuant to Article 54 (1) of the Act and shall monitor and control the implementation of such policies.
  • (2) The Mayor shall endeavor to expand the installation of facilities for saving energy in public facilities, including buildings, means of transportation, roads, ports, harbors, waterworks, and sewerage systems, and provide facilities for new and renewable energy in facilities open to the public, such as stadiums and gymnasiums.
  • (3) The Mayor shall endeavor to develop environment-friendly green offices by actively utilizing information and communications technology and services and establishing and implementing a plan for the promotion of energy saving.
  • (4) The Mayor shall endeavor to replace vehicles for official use under his/her jurisdiction with environment-friendly vehicles, such as hybrid automobiles, electric vehicles, hydro fuel cell vehicles, and compact cars, to expand means of transportation of low carbon and high efficiency.
  • Article 13 (Low Carbon, Green Growth in Local Communities)
  • The Mayor shall endeavor to prepare policies on low carbon, green growth, including the following measures, in order to develop robust and comfortable local communities:
    • 1. Expansion of carbon sinks through the development of urban forests and green paths;
    • 2. Development of low carbon, green village self-supporting in energy and resources;
    • 3. Establishment of a recycling system for waste metals in the region.

CHAPTER Ⅳ REALIZATION OF GREEN LIFE AND SUSTAINABLE DEVELOPMENT

  • Article 14 (Basic Principles of Green Life and Sustainable Development)
  • The Metropolitan Government's policies for the realization of green life and sustainable development shall be implemented in accordance with the following principles:
    • 1. The policies shall ensure the harmonious development, conservation, and management of national land so that citizens can realize that national land is the base of green growth and the exhibition that displays the results thereof and present and future generations can enjoy comfortable lives therein;
    • 2. The policies shall ensure reformation of the structures of the national land and urban spaces and architectural and traffic systems into the structures of low carbon, green growth and development of conditions under which producers and consumers can produce and purchase green products voluntarily and actively;
    • 3. The policies shall ensure that the Metropolitan Government, enterprises, and residents perform international agreements related to sustainable development and that citizens implement green life in their daily lives and establish green culture in the overall society;
    • 3. The policies shall ensure that the Metropolitan Government and enterprises promote environmental conservation by developing and improving systems for land use and production so as to protect the ecological base that constitutes the foundation of economic development.
  • Article 15 (Facilitation of Green Life Movement)
  • (1) The Mayor shall prepare policies that make residents and enterprises accustomed to green life and form a council with enterprises, non-governmental organizations, and other institutions so that a green life movement in each community can be developed comprehensively and systematically.
  • (2) The Mayor may provide related non-governmental organizations and institutions with administrative and financial support as may be necessary for them to develop the green life movement as a voluntary implementation movement under the initiative of the private sector.
  • (3) The Mayor may implement policies necessary to encourage public officials in the Metropolitan Government and each Si/Gun to take the lead in participating in the green life movement and providing participants in the movement with benefits.
  • (4) Pursuant to the Busan Metropolitan Government Ordinance on Rewards, the Mayor may reward an enterprise, a non-governmental organization, the assembly of representatives of residents in an apartment complex for its outstanding achievements in the green life movement.
  • Article 16 (Education and Promotion of Practice of Green Life)
  • (1) The Mayor shall expand activities for the education and promotion of low carbon, green growth to encourage enterprises and residents to voluntarily participate in policies and activities for low carbon, green growth and practice the green life culture in their daily life.
  • (2) The Mayor shall support school education on low carbon, green growth so that enterprises and citizens can implement green life naturally from their childhood and endeavor to train professional human resources regarding green growth in the region by intensifying the consolidation and integration of general liberal arts courses, vocational training courses, and basic lifelong educational courses.
  • (3) The Mayor shall conduct educational and promotional courses for public officials in the Metropolitan Government and each Si/Gun, public corporations established with investment or contribution from the Metropolitan Government, representatives of residents, women leaders, etc., as may be necessary for green growth.
  • Supplementary Provision
  • The ordinance shall be in effect one month after.

  • Article 1 (Effective Date)
  • The ordinance shall be in effect upon proclamation.
  • Article 1 (Revision of Other Ordinance)
  • (1) ~ (55) Omitted
  • (56) The Busan Metropolitan City Framework Ordinance for Low Carbon Green Growth shall be revised in part as follows:
    • “Administration Deputy Mayor” in Article 7 Paragraphs 3 and 7 and Article 9 Paragraph 2 shall be substituted with “Economy Deputy Mayor,” respectively.
