BUSAN METROPOLITAN CITY ORDINANCE ON SUPPORT FOR INTERNATIONAL DEVELOPMENT COOPERATION

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe matters necessary to enhance the appropriateness and efficiency of international development cooperation policies and effectively achieve the policy objectives of international development cooperation, in promoting international development cooperation projects pursuant to Articles 4 and 5 of the Framework Act on International Development Cooperation.
  • Article 2 (Definitions)
  • The terms used in this Ordinance are defined as follows:
    • 1. The term "official development assistance" means the flows of official financing to developing countries and to multilateral institutions, which are concessional in character and administered by the State, local governments or public institutions to support developing countries in achieving economic, social development and welfare improvements to enable attainment of self-reliance;
    • 2. The term "partner countries" means countries selected by the Government from among developing countries deemed to require international development cooperation, in consideration of the per capita national income levels and the stages of economic or social development, and other relevant factors of such developing countries, pursuant to Article 15 of the Framework Act on International Development Cooperation;
    • 3. The term "civil society organizations" means nongovernmental organizations that perform nonreligious, noncommercial, and nonpolitical activities to support the development of under-developed countries and developing countries, among civic and social organizations registered with the government ministries and offices or with local governments of the Republic of Korea;
    • 4. The term "public institutions" means public corporations and public institutions established by Busan Metropolitan City under the Local Public Enterprises Act and institutions established with the investment or funds from Busan Metropolitan City and designated and publicly notified by Busan Metropolitan City under the Act on the Operation of Local Government-Invested or -Funded Institutions.
  • Article 3 (Relationship to Other Ordinances of Busan Metropolitan City)
  • Except as provided in other municipal ordinances, this Ordinance shall apply to the implementation of international development cooperation projects.
  • Article 4 (Responsibilities of Mayor)
  • (1) The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall formulate policy measures necessary for international development cooperation in order to ensure the continuous implementation and efficient promotion of international development cooperation.
  • (2) The Mayor shall endeavor to improve the effectiveness of international development cooperation projects by collaborating with relevant civil society organizations, etc. to systematically advance international development cooperation projects.
  • (3) The Mayor shall endeavor to secure the necessary budget in consultation with the competent authorities, etc. under Article 12 of the Framework Act on International Development Cooperation in order to ensure the continuity of international development cooperation projects.
  • (4) The Mayor shall endeavor to promote and strengthen international development cooperation, including the performance of information exchanges, joint investigations, research, and the organization of events related to international development cooperation, with international organizations, foreign governments, foreign organizations, etc.
  • (5) The Mayor shall actively participate in the efforts of the international community to eradicate poverty and promote sustainable development in developing countries, and shall play a proactive role in achieving such goals.
  • (6) The Mayor shall endeavor to enhance transparency of international development cooperation projects.
  • Article 5 (Formulation and Implementation of Master Plan)
  • (1) The Mayor shall formulate and implement a master plan for international development cooperation (hereinafter referred to as "master plan") every three years in comprehensive consideration of the following principles and the foreign policies of the Republic of Korea in implementing international development cooperation:
    • 1. Respect for all the principles of the Charter of the United Nations;
    • 2. Support for the self-help efforts and capabilities of partner countries;
    • 3. Respect for the development needs of partner countries;
    • 4. Expansion of sharing of development experiences;
    • 5. Promotion of harmony and cooperation with the international community.
  • (2) The Mayor shall annually formulate and implement an action plan for international development cooperation (hereinafter referred to as “action plan”) based on the master plan.
  • (3) The Mayor shall evaluate the performance in accordance with an annual action plan and shall incorporate the results thereof in the master plan for the subsequent year.
  • Article 6 (Eligible Regions and Scope of Projects)
  • (1) Regions eligible for international development cooperation projects shall be as follows:
    • 1. Countries eligible for official development assistance, among the regions participating in international exchange;
    • 2. Developing countries on the list of countries entitled to assistance, which is managed by the Development Assistance Committee (DAC) of the Organization for Economic Cooperation and Development (OECD) among regions other than regions participating in international exchange;
    • 3. Regions deemed to require assistance among overseas regions affected by unexpected disasters;
    • 4. Regions where Korean expatriates reside aimed at establishing national identity;
    • 5. Other regions deemed by the Mayor to require assistance.
  • (2) Details of international development cooperation projects shall be as follows:
    • 1. Infrastructure improvement projects;
    • 2. Training projects, such as dispatching and inviting experts;
    • 3. Projects for dispatching overseas volunteers and for training international human resources;
    • 4. Projects for providing relief supplies to disaster areas;
    • 5. Multilateral international development cooperation projects, including support for international organizations;
    • 6. Other projects recognized as international development cooperation.
  • Article 7 (Composition of ODA Policy Dialogue)
  • (1) In order to deliberate and advise on the following official development assistance (hereinafter referred to as "ODA") projects, among international development cooperation projects, an ODA Policy Dialogue (hereinafter referred to as "Dialogue”) shall be established:
    • 1. Matters related to the formulation, implementation and evaluation of a master plan;
    • 2. Matters related to international development cooperation projects;
    • 3. Strengthening partnership and sharing information between departments (agencies);
    • 4. Identification of, planning for, and proposal for public invitation to, mutual cooperation projects in specialized fields;
    • 5. Monitoring ODA projects of the City, providing feedback, conducting civil engagement activities, etc.;
    • 6. Other matters necessary for promoting ODA-related policies.
  • (2) The Dialogue shall be composed of no more than 21 members, including one chairperson and one vice chairperson.
  • (3) The Director-General responsible for international development cooperation shall serve as the chairperson; a member elected from among and by commissioned members shall serve as the vice chairperson; and the team leader responsible for international development cooperation shall serve as the executive secretary.
  • (4) The Mayor shall appoint or commission members of the Diaglogue from among the following persons, and shall take into account gender balance when commissioning the members:
    • 1. The head of the division responsible for ODA from Busan Metropolitan City or a Gu/Gun;
    • 2. Executive officers and employees of institutions and organizations related to ODA;
    • 3. Experts in the relevant field, such as university professors;
    • 4. Other persons with extensive knowledge of and experience in ODA
  • (5) Matters not prescribed in this Ordinance related to the Dialogue shall be governed by the Busan Metropolitan City Ordinance on Establishment and Operation of Committees.
  • (6) The term of office of a commissioned member shall be two years, which may be renewed consecutively, and that of an ex-officio member shall be while they hold their primary office.
  • (7) The chairperson shall convene a meeting of the Dialogue, if deemed necessary; a majority of its members shall constitute a quorum and any resolution thereof shall require the concurring vote of a majority of those present.
  • Article 8 (Entrustment)
  • (1) In implementing international development cooperation projects under Article 6, projects may be entrusted to public institutions and civil society organizations.
  • (2) Each institution entrusted with an international development cooperation project pursuant to paragraph (1) (hereinafter referred to as "entrusted institution") shall ensure the expertise required for entrusted tasks, including the acquisition of specialized human resources suitable for handling entrusted affairs and shall take all measures necessary for preventing safety incidents.
  • (3) The Mayor shall manage or support to ensure professionalism and safety in the selection of entrusted institutions and the supervision of entrusted affairs, etc.
  • Article 9 (Promotional Activities for Civic Engagement)
  • The Mayor shall prepare and implement various public relations and civic awareness measures in order to ensure civic support for the need for international development cooperation and to encourage their participation.
  • Article 10 (Training of Specialized Human Resources)
  • (1) The Mayor shall endeavor to train specialized human resources in each area of international development cooperation.
  • (2) In order to train specialized human resources under paragraph (1), the Mayor may entrust a project therefor to a university or a specialized institution related to international development cooperation. In such cases, he or she may grant a subsidy, within the budget, to cover associated costs.

ADDENDA

  • Article 1 (Enforcement Date)
  • This Ordinance shall enter into force on the date of its promulgation.
  • Article 2 (Transitional Measures)
  • The ODA Policy Dialogue of Busan Metropolitan City established and operated before this Ordinance enters into force shall be deemed the Dialogue under this Ordinance.
  • Article 3 (Applicability to Term of Office for Members of the ODA Policy Dialogue)
  • The provisions of Article 7 (6) shall also apply to members already commissioned as members of the ODA Policy Dialogue of Busan Metropolitan City as at the time this Ordinance enters into force. In such cases, the date they are commissioned shall be an initial date in reckoning their term of office.
