Busan Metropolitan Government Ordinance on the Promotion and Support of Drone Industry

- Article 1 (Purpose)
- The purpose of this ordinance is to improve the quality of citizens' life and contribute to revitalizing the local economy by stipulating matters necessary for the use of big data and the cultivation of the big data industry. <Amended by Sep. 25, 2019>
- Article 2 (Definition)
- The terms used in this ordinance have the following meanings:
- 1. "Big data" means information generated by processing (collecting, creating, storing, combining, analyzing, and other similar acts) public information and usage history information through a device having information processing capability, and a technology that extracts value from it and analyzes the results;
- 2. "Big data industry" means an industry related to the production, distribution, utilization and management of big data to create added value;
- 3. "De-identification" means measures to delete or replace part or all of personal information through data value deletion, pseudonym processing, total processing, categorization, data masking, etc., so that a specific individual cannot be identified even if it is easily combined with other information.
- Article 3 (Relationship with Other Ordinances)
- Except the case of a special provision in other ordinances, the utilization of big data and the fostering of the big data industry shall be governed by this Ordinance.
- Article 4 (Responsibilities)
- ① Busan Metropolitan City (hereinafter referred to as the "City") shall endeavor to contribute to the revitalization of the local economy by expanding the use of big data by citizens. <Amended by Sep. 25, 2019.>
- ② The city shall endeavor to widely utilize big data to the extent that the confidentiality of individuals, corporations, or organizations is guaranteed.
- ③ In order to foster the big data industry, the city shall respect, promote, and support the business activities related to the autonomous information processing of information and communication service providers.
- ④ A person intends to use big data shall comply with their obligations in accordance with laws and conditions of use so as not to infringe on the public interest such as national security or the rights of others, and use it faithfully in good faith.
- Article 5 (Establishment and Implementation of a Basic Plan)
- ① The Busan Metropolitan Mayor (hereinafter referred to as the "Mayor") shall establish a basic plan for fostering the big data industry (hereinafter referred to as the "Basic Plan") every three years in order to systematically and efficiently foster the Big data industry. <Amended by Sep. 25, 2019>
- ② The basic plan shall include each of the following:
- 1. Basic goals and directions of utilizing big data and fostering the big data industry;
- 2. Matters concerning big data service and utilization;
- 3. Matters concerning fostering the big data industry through the use of big data;
- 4. Matters concerning the actual survey of the use of big data;
- 5. Matters concerning the promotion of private use of big data;
- 6. Matters concerning cooperation with related organizations;
- 7. Matters concerning education related to big data and training of professionals;
- 8. Matters concerning financing;
- ③ The mayor shall establish and implement a big data implementation plan every year according to the basic plan.
- Article 6 (Research on the Actual Condition)
- ① The mayor may research on the actual use of big data by citizens in order to establish and implement the basic plan and the implementation plan. <Amended by Sep. 25, 2019>
- Article 7 (Establishment of the Big Data Committee)
- ①The Mayor may establish the Busan Metropolitan Government Big Data Committee to deliberate on
the following matters for the utilization of big data by citizens and the fostering of the big
data industry: < Amended by Sep. 25, 2019>
- 1. Matters concerning the establishment of the basic plan and implementation plan and changes in important matters;
- 2. Matters concerning evaluation, analysis, and inspection of promotion performance according to the implementation plan;
- 3. Matters concerning the improvement of policies and systems related to the use of big data;
- 4. Matters concerning public-private cooperation to promote the use of big data;
- 5. Matters concerning support for fostering the big data industry;
- 6. Matters concerning securing big data experts;
- 7. Other major matters related to the use of big data and matters referred to deliberation by the Mayor;
- ② Matters deliberated by the Busan Metropolitan City Big Data Committee under Paragraph 1 shall be deliberated by the Busan Metropolitan City Informatization Committee under Article 6 of the Basic Ordinance on Informatization of Busan Metropolitan City.
- In this case, the matters deliberated by the Busan Metropolitan City Informatization Committee are considered to have been deliberated by the Busan Metropolitan City Big Data Committee.
- Article 8 (Big Data Officer)
- ① The mayor may have a big data officer to supervise the following affairs related to the
collection, analysis, and utilization of big data:
- 1. Collection, analysis, and utilization of big data;
- 2. Affairs on promoting private use of big data;
- 3. Affairs related to fostering the big data industry;
- 4. Affairs concerning ensuring de-identification of big data;
- 5. Discovery of big data policies and general affairs such as prior consultation, coordination, and support for each project.
- ② The mayo may have an organization and workers dedicated to the collection, analysis, and utilization of big data.
- Article 9 (Establishment of a Base for Utilization of Big Data)
- ① The mayo can establish and operate a system for collecting and utilizing big data.
- ② The Mayor may use the system for data analysis in the process of making policy decisions of the City and, upon request from the public or private sector, support the use of the system within the scope of the ordinance.
- Article 10 (Collection and Management of Big Data)
- ① In case a big data officer requests data from the head of a department that generates and manages big data in order to secure big data necessary for system operation, he/she shall cooperate with it, except the case of a special provision for in other Acts.
- ② In case the head of the department under paragraph ① is unable to provide data on big data, he/she shall notify the big data officer of the grounds therefor in writing.
- ③ The big data officer shall manage and efficiently utilize big data secured in accordance with legal procedures.
- ④ The big data officer may de-identify personal information included in big data and provide related data to those who intend to use big data according to relevant laws and regulations.
- Article 11 (Utilization of Big Data)
- The Mayor may promote the following projects to raise citizens' awareness of the utilization of big data and promote the utilization: <Amended by Sep. 25, 2019>
- 1. Development and provision of services using big data technology in the private sector such as tourism, medical care, transportation, and education;
- 2. Holding forums, seminars, and competitions to activate citizens' use of big data;
- 3. Discovery, reward, and promotion of successful cases of citizens' use of big data;
- 4. Education for citizens' use of big data;
- 5. Other projects necessary to raise citizens' awareness of the use of big data and promote its utilization.
- Article 12 (Big Data Industry Promotion Project)
- ① The mayor may promote the following projects to foster the big data industry through the use of big data by citizens. <Amended by Sep. 25, 2019>
- 1. Fostering companies and supporting start-ups related to the big data industry;
- 2. Fostering and supporting institutions and research institutes related to the big data industry;
- 3. Promoting pilot projects to foster the big data industry;
- 4. Improving expertise such as education and consulting to foster experts in the big data industry;
- 5. Other projects necessary for fostering the big data industry.
- ② The Mayor may organize a consultative body comprised of persons related to universities, research institutes, industries to foster the big data industry
- ③ The mayor may provide all or part of the necessary expenses within the scope of the budget to corporations or organizations under paragraph ①
- ④ In the case of supporting expenses under Paragraph 3, the necessary matters such as the procedure and method of payment shall be in accordance with the "Busan Metropolitan City Local Subsidy Management Ordinance".
- Article 13 (Education and Professional Training)

- ③ The mayor may promote policies to foster education and professionals necessary for the utilization of big data by citizens and the development of the big data industry.
- ④ The mayor may support the expenses necessary for big data-related education and professional training within the scope of the budget.
- Article 14 (Establishment and Operation of Big Data Centers)
- ① The mayor may establish the Busan Metropolitan City Big Data Center for the utilization and provision of big data by citizens. <Amended by Sep. 25, 2019>
- ② Busan Metropolitan City Big Data Center shall perform the following tasks.

- 1. Support for the establishment and implementation of the basic plan and implementation plan;
- 2. Encouraging citizens to participate in the use of big data;
- 3. Establishing and supporting infrastructure for big data private services;
- 4. Support for big data-based customized service projects for citizens;
- 5. Support for vitalizing private use of big data;
- 6. Training big data professionals;
- 7. Supporting the establishment and implementation of job support policies related to big data;
- 8. Investigation and research necessary for the utilization of big data and fostering the big data industry;
- 9. Other matters necessary for the utilization of big data and the development; of the big data industry.

- Article 16 (Entrustment of Affairs)
- ① The Mayor may entrust the following affairs to relevant institutions, corporations,
organizations in order to efficiently promote affairs concerning the utilization of big data
and the promotion of the big data industry of citizens: <Amended by Sep. 25, 2019>
- 1. Projects referred to in the subparagraphs of Article 11;
- 2. Affairs concerning education related to big data and training of professional personnel under Article 13;
- 3. Affairs concerning the management and operation of Busan Metropolitan City Big Data Center under Article 14.
- ② In case the affairs are to be entrusted under paragraph ①, matters not prescribed in this Ordinance shall be governed by the Busan Metropolitan Government Framework Ordinance on Entrustment to the Private Sector.
- Article 17 (Awards)
- The mayor may reward individuals, companies, and organizations that are recognized as having outstanding merit in the use of big data by citizens and the fostering of the big data industry according to the Busan Metropolitan Government Ordinance on Rewards." <Amended by Sep. 25, 2019>
Addendum
- Article 1 (Effective Date)
- This ordinance shall take effect one month after its promulgation.
- Article 2 (Amendment of other ordinances)
- Article 6 ① 4 shall be replaced to as subparagraph 5, and subparagraph 4 shall be newly
established as follows:
- 4. Matters concerning each subparagraph of Article 7 ① of the Busan Metropolitan Government Ordinance on the Utilization of Big Data and the Promotion of Big Data Industry.

- This ordinance will take effect on Jan. 1, 2020.
