BUSAN METROPOLITAN CITY ORDINANCE ON SUPPORT AND PROMOTION OF FAIR TRADE

- Article 1 (Purpose)
- The purpose of this Ordinance is to prescribe matters necessary for Busan Metropolitan City to support and promote fair trade and to improve citizens’ awareness and encourage their activities of ethical consumption.
- Article 2 (Definitions)
- The terms used in this Ordinance are defined as follows:
- 1. The term "fair trade" means a form of trade that ensures the protection of producers and workers who are not guaranteed adequate production profits while enterprises, etc. maximize their profits through free trade, and to provide more favorable trading conditions for the economic independence and sustainable development;
- 2. The term "fair trade organization" means an organization promoting social economy, while operating projects based on fair trade or performing activities to publicize and practice fair trade and ethical consumption;
- 3. The term "fair trade products" means goods and services developed or distributed by a fair trade organization.
- Article 3 (Basic Principles)
- The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall implement policy measures to support and facilitate fair trade in accordance with the following principles:
- 1. Enhancing mutual trust and respect among the interested parties to fair trade;
- 2. Establishing a social system in which human dignity and the value of labor are recognized;
- 3. Laying the foundation for facilitating fair trade campaigns driven and participated in by citizens.
- Article 4 (Relationship to Other Statutes, Regulations, and Municipal Ordinances)
- Except as otherwise provided in other statutes, regulations, or municipal ordinances, this Ordinance shall prevail for the support and promotion of fair trade.
- Article 5 (Responsibilities of Mayor)
- The Mayor shall actively support citizen-oriented fair trade projects and continuously implement policies to facilitate fair trade projects.
- Article 6 (Implementation Plans)

- (1) The Mayor shall formulate and execute an implementation plan for fair trade projects (hereinafter referred to as "implementation plan").
- (2) An implementation plan referred to in paragraph (1) shall include the following:
- 1. Basic objectives and main project plans to facilitate fair trade;
- 2. Progress and evaluation of implementation of fair trade projects;
- 3. Matters relating to laying the foundation and creating conditions for facilitating fair trade;
- 4. Matters relating to establishing and operating a private-public cooperative system for facilitating fair trade;
- 5. Matters relating to education and public relations for facilitating fair trade;
- 6. Other matters that the Mayor deems necessary in relation to fair trade.
- Article 7 (Scope of Support)
- The Mayor may provide necessary administrative and financial support for the following fair trade projects:
- 1. Projects for education and public relations to expand the basis for fair trade;
- 2. Projects for marketing fair trade products;
- 3. Projects for domestic and international exchange for the development of fair trade;
- 4. Other projects that the Mayor deems necessary in relation to fair trade.
- Article 8 (Preferential Purchase of Fair Trade Products)
- (1) The Mayor may preferentially purchase fair trade products within the extent permitted by relevant regulations, such as the Act on Contracts to Which a Local Government Is a Party and the Busan Metropolitan City Rule on Budget and Fund Accounting.
- (2) The Mayor may recommend public institutions, related organizations, etc. located within the jurisdiction to preferentially purchase fair trade products.
- (3) If necessary to facilitate the production and purchase of fair trade products, the Mayor may enter into an agreement with the heads of public institutions or private organizations, enterprises within the jurisdiction, etc.
- (4) The Mayor may collect information necessary for facilitating the production and purchase of fair trade products and provide such information to public institutions or private organizations, enterprises within the jurisdiction, etc.
- Article 9 (Education and Training)
- In order to enhance understanding of fair trade, the Mayor may formulate and implement an education and training plan for public officials under his or her jurisdiction or persons, etc. in charge of procurement in affiliated public institutions at least once a year.
- Article 10 (Establishment of Seller's Mark of Fair Trade Products)
- (1) The Mayor may establish a mark indicating stores and outlets that handle and sell fair trade products (hereinafter referred to as "seller's mark") to facilitate the distribution of fair trade products within the jurisdiction.
- (2) The Mayor may compose a separate deliberative committee for establishing a seller's mark and designating the place of use.
- Article 11 (Awards)
- The Mayor may grant awards to individuals, organizations, etc. that have made a great contribution to fair trade pursuant to the Busan Metropolitan City Ordinance on Awards.
- Article 12 (Application Mutatis Mutandis)
- Except as provided in this Ordinance, the Busan Metropolitan City Ordinance on the Management of Local Subsidies shall apply mutatis mutandis to matters necessary for the support, management, etc. of fair trade organizations.
- Article 13 (Enforcement Rules)
- Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of Busan Metropolitan City.
ADDENDUM
- This Ordinance shall enter into force on the date of its promulgation.
